This Privacy Policy explains how AskBurg AI Systems ("AskBurg", "we", "us", or "our") acts as the data controller and handles information when you use AskBurg.com and the AskBurg assistant platform (together, the "Service"). We collect only what we need to operate the Service and provide clear answers. AskBurg is operated by Shobhit Kumar Prabhakar, trading as AskBurg AI Systems. By using the Service, you agree to the practices described in this policy.

We collect the following kinds of information:

• Content you provide. The questions, prompts, uploaded reference documents, messages sent to custom chatbots, and details you submit through our contact forms (such as your name and email address).
• Usage information. Basic technical telemetry generated when you use the Service, such as approximate request times, pages visited, and aggregated, non-identifying usage patterns.
• Device and connection data. Technical network metadata including IP address, browser type, and device identifiers used for security, rate limiting, and abuse prevention.

We do not ask for sensitive personal data. Do not submit confidential or sensitive details in public conversations.

We use the information we collect to:

• Provide, operate, and maintain the Service and process your requests.
• Generate contextual answers through fine-tuned open-weight language models.
• Index and retrieve reference documents for custom chatbot workspaces (RAG).

Model Training Policy: Your data is never used to train or fine-tune our models without your explicit opt-in consent.

Where applicable law requires a legal basis, we rely on: your consent, performance of a contract with you, legitimate operational interests in securing and maintaining the Service, and compliance with applicable statutory obligations.

5. Subprocessors and how we share information

We do not sell personal data. We share information only with trusted subprocessors required to operate the Service, subject to strict confidentiality and data-protection terms:

• Cloud Compute and Hosting Providers: Secure cloud infrastructure providers for server hosting, API compute, and database storage.
• Cloudflare: Content delivery network (CDN), DDoS mitigation, reverse proxy, SSL/TLS encryption, and edge security.
• Brevo (Sendinblue): Transactional email delivery and inbound contact routing.
• Anthropic (Claude API): for generating AI responses. API data is not used to train models under Anthropic's commercial terms.
• Legal authorities: Where required by applicable Indian or international law, or to protect the safety, security, and integrity of users and our platform.

6. Hosting region and data retention

Hosting Region: AskBurg AI Systems hosts its core web services and model inference infrastructure in secured cloud data centers in compliant regions with industry-standard encryption at rest and in transit.

Retention Periods:

• Inference and Query Logs: We retain operational access logs and raw query transcripts for up to 30 days solely for debugging, rate-limiting, and abuse prevention, after which they are purged or de-identified.
• Customer Documents (RAG): Uploaded documents and vector indices for custom chatbots remain stored securely in your private workspace until you delete them or close your account.
• Account and Billing Records: Stored for the duration of the customer relationship and statutory tax or regulatory retention periods.

7. Security

We enforce modern technical and organizational safeguards, including TLS 1.3 encryption in transit, restricted access controls, and network firewalls. No transmission over the internet is completely secure; we advise users to avoid transmitting sensitive secrets or credentials.

8. Your rights and choices

Under applicable data protection laws (including the Digital Personal Data Protection Act 2023), you have the right to access, rectify, or request erasure of your personal data, or to withdraw prior consent. To submit a request, contact us at [email protected].

9. Cookies and similar technologies

We use strictly necessary cookies for session authentication, security checks, and basic site navigation. We do not use third-party behavioral advertising trackers.

10. Children's privacy

AskBurg is not intended for anyone under 18. We do not knowingly collect personal data from children, as defined under India's Digital Personal Data Protection Act, 2023 and the US Children's Online Privacy Protection Act (COPPA).
