1. Acceptance of terms

These Terms and Conditions ("Terms") govern your access to and use of AskBurg.com and the AskBurg assistant (together, the "Service"). These terms are an agreement between you and AskBurg AI Systems ("AskBurg", "we", "us", or "our"). AskBurg is operated by Shobhit Kumar Prabhakar, trading as AskBurg AI Systems. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

AskBurg provides an AI-powered assistant and custom-chatbot platform that generates text responses based on user prompts and documents. We may add, change, or remove features at any time, and we may set or adjust usage limits to keep the Service reliable and fair for everyone.

3. Eligibility and accounts

You must be at least 18 years old to use AskBurg. By using the Service you confirm that you are 18 or older. AskBurg is not designed for, marketed to, or intended for use by anyone under 18. If we learn that a user is under 18, we will suspend the account and delete its data.

Organizations deploying AskBurg chatbots must not make them available to users under 18 unless they have a separate written agreement with AskBurg AI Systems that includes additional child-safety safeguards.

If you create an account, you are responsible for the accuracy of your information, for keeping your account credentials secure, and for all activity that occurs under your account.

4. Acceptable use

You agree not to use the Service to:

• Break the law or infringe the rights of others.
• Generate or distribute harmful, hateful, deceptive, or abusive content.
• Attempt to disrupt, overload, reverse engineer, or gain unauthorised access to the Service.
• Circumvent usage limits, security, or rate limiting.
• Use the Service to build a competing product by improperly extracting its outputs at scale.
• Submit content that contains malware or that you do not have the right to share.

5. Your content

You retain ownership of the content and documents you submit to the Service. You grant us a limited licence to process that content solely as needed to operate the Service and provide responses to you. You are responsible for the content you submit and for how you use the responses you receive.

6. AI output and accuracy

The Service uses AI models to generate responses, which may be inaccurate, incomplete, or out of date. Output is provided for general informational purposes only and does not constitute professional advice (including legal, medical, or financial advice). You are responsible for evaluating and verifying any output before relying on it.

7. Intellectual property

The Service, including the AskBurg name, logo, software, and design, is owned by AskBurg AI Systems and protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service. You may not copy, modify, or create derivative works of the Service without our written permission.

8. Plans, payments and refunds

AskBurg provides a Free tier ($0) for individual exploration. Paid plans include AskBurg Pro ($19/month) and Organizations ($79/month for 5 seats, plus $15/user/month for additional seats). Custom chatbots, private RAG knowledge bases, and white-label enterprise solutions are billed based on usage and commercial quotes. Prices are stated in USD; Indian customers are billed in INR plus applicable GST.

Paid plans are currently offered under early access launch pricing. Subscriptions are billed on a recurring monthly basis until cancelled. You may cancel your subscription at any time, and cancellation takes effect at the end of the current billing cycle.

Subscription fees are generally non-refundable once the billing period has begun, except where mandatory applicable law provides a statutory right of refund. In the event of billing errors or service disruptions, contact [email protected] within 7 days of the charge for resolution.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, AskBurg AI Systems and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months before the claim.

11. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we need to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of India; courts in India have exclusive jurisdiction over any dispute or claim arising out of or relating to these Terms or the Service.
